Fandation provides template privacy policies, terms of service, giveaway rules, and other documents that can have legal effect.
These templates were designed by lawyers with experience in privacy and technology, provided in good faith, and we believe they work well for most artists or music industry companies.
However, Fandation is not a law firm and does not engage in the practice of law. We do not – and cannot – provide legal advice or legal representation.
Any service providing templates like ours is faced with choices between simplicity/ease of use and detail/complexity.
Do we ask many granular questions to customize each and every detail or do we generalize and only ask for essential information?
Our view is that Fandation’s value primarily comes from minimizing complexity so our standard templates are designed to prioritize simplicity, affordability, and usability.
Put another way, we have been around artist marketing for a long time and have a pretty good understanding of how most artists operate. That experience is “baked in” to our templates and we don’t ask questions when we probably already know the answer.
The tradeoff is that our standard templates may not be suitable for artists who do something unique and they are not suitable for use outside the music industry.
We do offer customization and individual support options for unique or particularly complex scenarios. These customizations are more complex (and therefore more expensive) but they are available for artists who are big or unique enough to need them.
Transparency is important to us so we want to be sure that we clearly explain exactly what Fandation is and the limitations in our standard templates. There is no such thing as a legal magic wand and we don’t want to mislead you otherwise.
The bottom line is that most artists do not have access to affordable privacy policies, terms, or giveaway rules. Fandation is a major step forward for those artists and the industry.
It is important to note a few things about Fandation’s templates and services:
- Fandation templates are not legal advice, advertising, or a solicitation, nor are they a substitute for professional legal advice.
- Information on our site and in our services is provided for educational and informational purposes only.
- While we do our best to create simple and effective templates, the music industry is complex and laws change regularly. Legal compliance also requires more than having the right documents. Because of this, Fandation cannot guarantee:
- that our templates are appropriate for every artist, company, or situation; or
- that our templates meet all applicable legal requirements in any jurisdiction.
- We recommend consulting a lawyer to ensure that your use of Fandation templates is appropriate to your needs.
Use of and/or reliance on information contained on our website or as part of our services is entirely at your own risk.
Fandation’s partner law firm Reverb Data (operated by Fandation founder Andy Blair) offers legal services on issues related to data in the music industry. If you have legal questions or concerns about data, contracts, or similar issues, Reverb Data may be able to help.
Please let us know if you have any questions or concerns about Fandation, our templates, or our status as a non-legal services provider.
